    Filing an SSDI Appeal? Here’s How to Increase Your Chances of Winning It

    Even if it is clear you have a disability that qualifies you to get Social Security Disability Insurance (SSDI) benefits, the Social Security Administration (SSA) may still deny your application. In fact, the agency denies a lot of applicants who are eligible for benefits. 

    If SSA denied your claim, you must file an appeal of its decision. If the agency denies your initial request for reconsideration, you must attend a court hearing during which you need an Arkansas social security disability attorney to increase your chances of winning your appeal. Read on to know how you can make this happen:

    Hire an Attorney

    To win your SSDI appeal, retain a skilled attorney to represent you. Your attorney will file the appeal and supporting documentation on your behalf. They are aware of what the administrative law judge or ALJ will look for and make sure you give all the evidence to prove your disability. Also, your attorney will represent you at the hearing. 

    Give Medical Evidence

    You need medical evidence to convince the SSA that you sustained a medical condition, which makes it impossible for you to work. You need to give the agency your ongoing medical records of examinations, doctor statements, diagnostic tests, and other evidence that prove you are disabled. Ensure this information is submitted to the SSA whenever you see your doctor. 

    Show that Your Medical Condition is Worsening

    You need to be able to provide evidence that you have a worsening medical condition and include this when you file the appeal. Your medical documentation will be reviewed by the ALJ before your scheduled hearing. By showing you have a worsening medical condition, you may be able to convince the judge that you have a real disability. 

    Be Present at the Cumulative Exam

    You may be required by the SSA to attend a cumulative examination. Depending on the type of disability you have, this exam can be physical or mental. It is meant to determine the severity of your disability and its impact on your ability to work. Ensure you attend this exam when it is scheduled for you.

    Come to the Hearing Well Prepared

    Keep in mind that whatever you will say at the hearing will influence the outcome of your appeal. By hiring a lawyer, you have an expert to help you prepare for it. Your attorney knows the kinds of questions you may be asked and guide on how to answer them.
